Vixdeo is a service of Synaxis Systems LLC. We respect copyright and expect the people who use the service to do the same. We respond to notices of claimed infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This page identifies our designated agent and explains how to send a notice of infringement, how to send a counter-notification, and what we do about repeat infringers.

How to send a notice of infringement

If you own a copyright, or are authorized to act on the owner's behalf, and believe that material available on Vixdeo — for example, a work in the public gallery (vixdeo.com/w/…) — infringes it, send a written notice to our designated agent. To be effective under 17 U.S.C. § 512(c)(3), it must include substantially the following:

  1. A physical or electronic signature of the owner of the exclusive right that is allegedly infringed, or of a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed or, if a single notice covers multiple works at a single site, a representative list of those works.
  3. Identification of the material claimed to be infringing that is to be removed or access to which is to be disabled, with information reasonably sufficient for us to locate it: its address (URL) on Vixdeo and, for a fragment of a video, the time at which it appears.
  4. Information reasonably sufficient for us to contact you: your address, telephone number and, if available, email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

When we receive a notice that meets these requirements, we promptly remove or disable access to the material and take reasonable steps to notify the person who posted it. If a notice is missing any of these elements, we may ask you to complete it before we act.

The “Report” button under every work in the gallery lets you tell us about any problem, including a copyright one. A formal DMCA notice goes to the designated agent with the elements above.

Please note that under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for the resulting damages, including costs and attorneys' fees. If you are not sure whether the use infringes your rights — for example, because it may be fair use — consider consulting a lawyer before sending a notice.

Counter-notification

If we removed or disabled material you posted because of a notice and you believe that happened by mistake or misidentification, you may send a written counter-notification to our designated agent. To be effective under 17 U.S.C. § 512(g)(3), it must include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or to which access was disabled, and the location at which it appeared before that happened (its address on Vixdeo).
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, for any judicial district in which Synaxis Systems LLC may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent.

When we receive a counter-notification that meets these requirements, we send a copy — including your contact details — to the person who submitted the original notice and tell them that we will restore the material in 10 business days. We restore it no less than 10 and no more than 14 business days after receiving the counter-notification, unless our designated agent first receives notice that the person has filed an action seeking a court order to restrain you from engaging in the allegedly infringing activity. The 17 U.S.C. § 512(f) liability also applies to anyone who knowingly materially misrepresents that material was removed by mistake.

Repeat infringers

Synaxis Systems LLC has adopted and implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. It may also remove content from, or limit gallery access for, any account that infringes the rights of others, whether or not it is a repeat infringer.

Material published on other platforms

If the material is published on another platform — for example, a YouTube channel a user published to from Vixdeo — send the notice to that platform, which is the one hosting it.
